Terms of Service

1. Acceptance of terms
By registering for or using Talent Atrium, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the platform.
These terms apply to all users of the platform, including candidates, recruiters, and visitors.
2. Description of the service
Talent Atrium is a structured candidate evaluation platform. It provides:
- A public job board where candidates can browse and apply to vacancies - A candidate portal for managing profiles, assessments, and applications - A recruiter portal for creating and managing vacancies and reviewing candidate evaluations - An automated evaluation engine that scores candidates against vacancy requirements
The platform does not make hiring decisions. All decisions regarding shortlisting, rejection, and hiring remain with the recruiter.
Data processing roles: Talent Atrium acts as the data controller for all personal data collected through the platform. Recruiters who access candidate evaluation data act as independent data controllers for any processing they undertake following review of that data. Each party is responsible for their own compliance with applicable data protection law.
3. Candidate accounts
By creating a candidate account, you confirm that:
- The information you provide, including CV content and assessment responses, is accurate and your own - You are applying to vacancies in good faith - You will not submit applications on behalf of another person without their explicit consent - You will not attempt to manipulate or circumvent the evaluation process
You are responsible for maintaining the confidentiality of your account credentials.
4. Recruiter accounts
By creating a recruiter account, you confirm that:
- You are authorised to post vacancies on behalf of the organisation named in your account - The vacancies you post are genuine and legally compliant - You will not use candidate data for any purpose beyond making a hiring decision for the stated vacancy - You will not share candidate evaluation data with third parties outside your organisation without a lawful basis - You understand that all hiring decisions are your responsibility - You will not make hiring decisions based solely on an automated evaluation score without human review
Recruiters must comply with applicable employment law, anti-discrimination law, and data protection law in their jurisdiction. Recruiters using this platform in jurisdictions with AI-specific employment law requirements (including New York City Local Law 144, Colorado SB24-205, California FEHA, and the Illinois Human Rights Act) are responsible for ensuring their own compliance with applicable obligations in those jurisdictions.
5. Acceptable use
You must not use the platform to:
- Post false, misleading, or discriminatory vacancy listings - Submit fraudulent or misrepresented candidate information - Scrape, harvest, or systematically extract data from the platform - Attempt to access accounts, systems, or data that you are not authorised to access - Interfere with the operation of the platform or its evaluation systems - Use the platform for any purpose that violates applicable law - Rely solely on an AI-generated evaluation score to reject a candidate without human review of the evaluation - Use candidate evaluation data to discriminate on the basis of any protected characteristic
6. Intellectual property
The platform, its evaluation systems, AI models, software, design, and content are the intellectual property of Talent Atrium. You may not copy, modify, distribute, or reverse-engineer any part of the platform without written permission.
Candidate-submitted content (CVs, assessment responses) remains the intellectual property of the candidate. Recruiter-submitted content (vacancy descriptions, requirements) remains the intellectual property of the recruiter. By submitting content to the platform, you grant us a limited licence to process that content for the purpose of providing the service.
7. Limitation of liability
The platform provides evaluation assistance. It does not guarantee employment outcomes for candidates or successful hires for recruiters.
To the maximum extent permitted by law, Talent Atrium is not liable for:
- Hiring decisions made by recruiters - Outcomes of applications submitted by candidates - Errors or inaccuracies in AI-generated evaluation reports - Loss of data or service interruptions - Recruiter non-compliance with applicable employment or data protection law
Nothing in these terms limits liability for fraud, gross negligence, or anything that cannot be limited by law.
8. Termination
We reserve the right to suspend or terminate accounts that violate these terms or are used in a manner that harms the platform or other users.
You may close your account at any time from your portal settings. On account closure, your personal data will be deleted in accordance with our Privacy Policy and Data Retention Policy.
9. Changes to these terms
We may update these terms from time to time. Material changes will be communicated by email to registered users. Continued use of the platform after changes take effect constitutes acceptance of the updated terms.
10. Governing law
These terms are governed by the laws of the jurisdiction in which Talent Atrium is registered. Disputes will be resolved in the courts of that jurisdiction unless applicable law requires otherwise.
